Because it is less stressful and less expensive than litigation, people with family law needs sometimes choose mediation as an alternative. Mediation lets the family develop an agreement they can live with instead of trusting the decision to a judge. When children are involved, mediation can be especially valuable.
At McPhail Law, two of our family law attorneys have completed the West Virginia Supreme Court family law mediator training. We have the knowledge and experience you need to resolve legal disputes.
If you think mediation may be right for your family, call our Wheeling office at (304) 905-9783 to schedule an appointment with a mediation attorney.
The court may order mediation if parents cannot agree on custody. However, many families choose mediation on their own to resolve divorce, custody and other family law issues.
A mediator does not represent either side in a dispute. The mediator’s role is impartial. The mediator does not advise either party but does help people brainstorm solutions in a collaborative effort toward resolving differences.
Mediation is a confidential process. Nothing said in a mediation session is admissible in court. The setting is relaxed, and the focus is on reaching an agreement that works for all parties. Unlike a trial, it is not an adversarial process, so it is better for maintaining good relationships between parties. It also allows for more flexibility and creativity in parenting plans.
Mediators cannot also be an attorney for the same client. We can happily refer you to a qualified family law attorney to represent you in mediation sessions, or we can serve as your lawyer in a session where we are not the mediators.
